I came across this at DIGG and I'm shaking my head. First of all a man was driving at 100MPH in a 45MPH zone and hit a boy riding his bike killing him... then he has the nerve to sue the kids parents for damages to his car. A thing that adds insult to injury over this whole thing is peoples attitudes towards it. Some people actually want to put blame on the kid saying something to the effect of, "If only he wore more reflective gear the drive would have been able to swerve around him and he'd be living today". Someone said and I quote,
"Imagen going 100mph and all of a sudden seeing a person's reflectors. I don't know about you guys but id probably swerve out of the way to avoid him/her and in turn crash into a tree or something, out of reflexes." and another said,
"The whole point of reflective gear is to NOT GET HIT. Obviously it's not gonna help you survive if you do. Even going 100mph you can spot the reflections way in advance. Both parties are to blame."
I call bullshit on this.... and I don't care how much reflective surfaces the kid was wearing the driver was driving 100MPH in a 45MPH zone and his actions later tell me that he doesn't have much empathy for others. The blame should be all his. Even if he was going slower like, say 70MPH that doesn't give him much time to do a lot.
Someone else commented:
"A driver of an uninsured vehicle belonging to his girlfriend killed my brother's 12 yr old boy crossing the road.. at a crosswalk... wearing a helmet with reflective surface. The driver was unemployed and likely drunk. The police never gave a Breathalyzer. The man never went to jail. My nephew is still dead."
I myself have noticed that there are quite a few jaywalkers in my city and sometimes they don't seem to think or care that a car is coming. But That still doesn't excuse careless and wreckless driving. The person with the car has the upper hand and no one on foot can compete against tons of hurtling metal coming at them.
